Pursuant to the Official Code of Georgia Annotated, O.C.G.A. § 2-7-97, notice is hereby given that the Georgia Department of Agriculture will hold a public hearing on April 16, 2012, at 10:30 a.m. in room 201 of the Agriculture Building, located at 19 Martin Luther King Jr. Drive, Atlanta Georgia 30334-4201.
Such hearing shall be for the purpose of considering the adoption of amendments to Rules 40-21-2-.01, 40-21-3-.01 and 40-21-4-.01 relating to commercial pesticide applicators and the addition of “Mosquito Control” as a category to the Commercial Pesticide Applicator’s License. The Department will also be accepting written comments from March 15, 2012, to the close of business (4:30 pm EDT) on April 16, 2012.
Synopsis, Main Features and Differences:
Over 50 varieties of mosquitoes live in Georgia, each of which poses a potential danger to public health, livestock, and wildlife as mosquitoes are known carriers of deadly diseases like the West Nile virus, yellow fever, and malaria. Because of the dangers that mosquitoes pose, the Department feels it is important to provide a definition of the mosquito control category, establish minimum standards of competency, and set the number of training hours required for license recertification.
In order to effectuate the above, the Department is seeking to add a category for “mosquito control” to the commercial pesticide applicator’s license in Rules 40-21-2-.01, 40-21-3-.01, and 40-21-4-.01. This new category will allow business owners to operate pest management companies that wish to offer services to control mosquitoes and other biting insects on behalf of their customers and the general public.
The proposed change will add new subsection (r) to Rule 40-21-4-.01 to provide a definition of “mosquito control.” Mosquito control would include commercial applicators using or supervising the use of restricted use pesticides, or state- restricted pesticide uses, in the control of mosquitoes on residential, commercial and public grounds.
Additionally, Rule 40-21-3-.01 would be amended to include category specific standards for mosquito control, which includes practical knowledge of (1) vector-disease transmission as it relates to and influences pesticide application; (2) life cycles and habitats as a basis for strategy in control of mosquitoes; (3) a wide variety of breeding and habitat environments ranging from outdoors to permanent and temporary bodies of water; and (4) the importance and use of non-chemical methods such as sanitation, drainage and waste disposal. The number of training hours regarding license recertification for mosquito control is added to Departmental Rule 40-21-4-.01 relating to the recertification requirements and commercial applicator license renewals.
